Terms of Use

These terms apply to the Dead End Express app ("the app"), published by Nivaash (nivaash.nl), based in the Netherlands ("we", "us"). By downloading or playing the app, you agree to these terms. If you got the app from the Apple App Store, Apple's Standard End User License Agreement also applies. If you got it from Google Play, the Google Play Terms of Service also apply.
1. Using the app
We give you a personal, non-exclusive, non-transferable licence to use the app for your own enjoyment. Please don't copy, modify, resell or reverse-engineer it, or use it in a way that breaks the law or harms the app or other people.
2. Hearts, Coal, Rewinds and Signals
The game is free to play. Hearts come back over time; restarting a level you've started and not yet cleared uses one. Coal, Rewinds and Signals are earned by playing, by watching optional reward videos, or bought. Stars and results can't be bought. Hearts, Coal, Rewinds, Signals, stars and other game items have no money value outside the game and cannot be exchanged, transferred or refunded, except where the law says otherwise.
3. Purchases
Coal packs are one-time purchases of game items. Prices are shown in the store before you buy. Payment and refunds are handled by Apple or Google under their rules.
4. Express Pass subscription
The Express Pass is an auto-renewing subscription, monthly or yearly. It gives unlimited hearts, no ads, a daily Coal, Rewind and Signal, and exclusive cosmetics while it is active. Payment is charged to your Apple or Google account when you confirm the purchase. It renews automatically at the same price unless you cancel at least 24 hours before the end of the current period; renewals are charged within the 24 hours before that. You can manage or cancel it at any time in your App Store or Google Play subscription settings. Cancelling stops the next renewal; you keep the Pass until the end of the period you paid for. If a free trial is offered, any unused part of it ends when you buy a subscription.
5. Your game progress
Your progress is saved only on your device. If you delete the app, reset your progress or change devices, your progress may be lost. An Express Pass can be restored with Settings → Restore purchases; progress and Coal already bought cannot.
6. Changes and availability
We may update the app, for example to add stations and levels or change features or balance. We may also stop offering it. We try to keep the app running smoothly but cannot promise it will always be available or free of errors.
7. Ownership and real places
The app, its levels, art, names and other content belong to us or our licensors. These terms don't give you any rights to them other than the licence in section 1. The game's stations are original illustrations inspired by real railway stations and cities, named to describe them. Dead End Express is not affiliated with, sponsored by or endorsed by Indian Railways or any other railway.
8. Liability
The app is provided "as is". As far as the law allows, we are not liable for indirect or consequential loss, or for lost progress. Nothing in these terms limits rights you have as a consumer that cannot be limited by law.
9. Privacy
How the app handles information is explained in our Privacy Policy.
10. Governing law
These terms are governed by Dutch law. If you are a consumer living elsewhere, you keep the protection of the mandatory laws of your country, and you may bring a claim in your local courts.
11. Changes to these terms
We may update these terms. We'll change the date at the top, and if the changes are important we will mention them in the app. If you keep playing after a change, you accept the updated terms.
